STUDY LEAVE RULES ALONGWITH EXTRACTS FROM CIVIL SERVICES RULES (PUNJAB) VOLUME-I, PART-I ABOUT HOSPITAL AND STUDY LEAVE (PUNJAB GOVERNMENT) — Study leave should not ordinarily be granted to government servants who have less than five years’ service. Such leave shall not be granted to government servants within three years of the date of superannuation or retirement. The period of study leave is upto four years and it is granted once in entire service to a government servant. Extraordinary Leave (EOL) can be granted in conjunction with study leave. A government servant admitted in the Ph.D course shall be allowed full pay during study leave. Study leave will be counted as service for promotion and pension but not for leave.

THE SALES TAX ACT, 1990 (AMENDED UP TO 30th JUNE, 2023) AND THE SALES TAX RULES, 2006 (UPDATED UP TO 31st OCTOBER, 2023) — It extends to the whole of Pakistan. It shall come into force on such date as the Federal Government may, by notification in the official Gazette, appoint. Subject to the provisions of this Act, there shall be charged, levied and paid a tax known as sales tax at the rate of seventeen per cent of the value of taxable supplies made by a registered person in the course or furtherance of any taxable activity carried on by him and goods imported into Pakistan, irrespective of their final destination in territories of Pakistan. Any person who has collected or collects any tax or charge, whether under misapprehension of any provision of this Act or otherwise, which was not payable as tax or charge or which is in excess of the tax or charge actually payable and the incidence of which has been passed on to the consumer, shall pay the amount of tax or charge so collected to the Federal Government.

RULES FOR THE USE OF STAFF CARS, 1980 (FEDERAL GOVERNMENT) — They shall apply to the staff cars maintained by various Divisions including the staff cars maintained by the Cabinet Division in the Central Pool and, unless stated otherwise, to operational vehicles. They shall come into force at once. Staff Car means motor vehicle of any type maintained by Government. Pool Car means a staff car maintained by the Cabinet Division in the Central Pool. It is clarified that operational vehicles have been defined in 2(vii) of the Rules for the Use Staff Cars-1980. These rules are applicable in cases of all the vehicles maintained by Ministries / Divisions, Departments and Subordinate Offices unless stated otherwise. Rule 3(5) of the Rules for the Use of Staff Cars, 1980 lays down that no Division shall purchase a staff car (means a motor vehicle or any type) unless a NOC is obtained from the Cabinet Division. All the relevant rules of the Rules for the Use of Staff Cars – 1980 regarding repairs and maintenance, up-keep of vehicles their records etc are equally applicable in cases of operational vehicles.

THE PUNJAB LOCAL GOVERNMENTS (WORKS) RULES, 2017 — They shall come into force at once. They shall apply to the Local Governments, except the District Education Authority, District Health Authority and Union Councils established under the Punjab Local Government Act, 2013. Work means a construction work, consisting of erection, assembly, repair, renovation or demolition of a building or structure or part thereof for site preparation, excavation, installation of equipment or materials and decoration and finishing and includes incidental services such as drilling, mapping, satellite photography, seismic investigations and similar other activities, if the value of those services does not exceed the total value of the work.

THE PUNJAB LOCAL GOVERNMENTS (CONTRACT) RULES, 2017 — They shall come into force at once. They rules shall apply to all the Local Governments, except the District Education Authority, District Health Authority. Contract means an agreement enforceable at law. Contractor means a person entering into a contract with a Mayor or Chairman or any office duly authorized by the Mayor or Chairman on behalf of the Local Government. No contract shall be binding on a Local Government unless it is made in conformity with the provisions of these rules and any other law for the time being in force in this behalf. A formal deed of agreement for every contract, after observing the procedure specified in the relevant rules, shall be executed between the local Government by the concerned Mayor or Chairman or an officer authorized by the Mayor or Chairmen and the contractor.

A MANUAL ON TRAVELLING ALLOWANCE RULES (FEDERAL GOVERNMENT) — Travelling Allowance is a kind of compensatory allowance granted to meet personal expenditure necessitated by the special circumstances in which duty is performed. Actual Travelling Expenses means the actual cost of transporting a Government servant with his domestic servants and personal luggage, including charges for ferry and other tools and for carriage of camp equipment, if necessary. It does not include charges for hotels, travellers bungalows or refreshments, tips and expenses on breakage of crockery and furniture, etc. In the case of officers who are allowed to draw the whole or a part of their pension in addition to pay, the T.A. admissible will be determined with reference to pay plus pension subject to the condition that only such portion of the pension will be taken into account for this purpose as, together with the pay, does not exceed the maximum pay of the post.

THE PUNJAB DISTRICT AUTHORITIES (DELEGATION OF FINANCIAL POWERS) RULES, 2017 — They shall come into force at once. The Administrative Department means the School Education Department of the Government in respect of the District Education Authorities and the Primary & Secondary Healthcare Department of the Government in respect of District Health Authorities. The authorities specified in column 3 of Second Schedule shall exercise the powers to the extent given in column 4, in respect of the items mentioned in column 2 thereof. No authority shall accord sanction resulting directly or indirectly for its own advantage. The powers delegated under these rules shall not be further delegated.

They are supplementary to the general rules in Financial Handbook Nos. 1 and 2 which are also applicable to the Public Works Department unless there be something repugnant in the subject or context or except to the extent that they are modified by the rules in this part. PART II – RULES RELATING TO THE FOREST DEPARTMENT – This part contains the Financial and Accounts Procedure Rules (Other than those of the kind referred to in rule 1.2) which are special to the Forest Department. They are supplementary to the general rules in Financial Handbook Nos. 1 and 2 which are applicable to the Forest Department unless there be something repugnant in the subject or context or except to the extent that they are modified by the rules in this Part.

THE PUNJAB LOCAL GOVERNMENT ADVERTISEMENTS BYE-LAWS, 2017 — Advertisement includes advertisements displayed, placed on the roads, green belts or verges or private or Government premises, shops, houses, hospitals, educational institutions, petrol pumps, fences, vehicles, balloons streamers, posters, banners or any other thing placed, painted, pasted or installed and visible from a public place and is intended to inform the viewer of the availability of a service, product or outlet. Advertising substance includes trivisions, neon signs, hoardings, billboards, cutouts, pole signs, sky signs, directional boards, banners, streamers, moppy signs, LED screens, temporary advertisement structures, posters, one way vision stickers, temporary publicity stalls, hot-air balloon, blimp and moving vehicle. Banners means publicity material comprising cloth, flex or parachute installed temporarily with ropes for purposes of advertisement in a horizontal direction. Billboard / hoarding means a publicity board made of MS sheet on iron poles or girders fixed independently on a structure other than a building façade.

THE PUNJAB DELEGATION OF FINANCIAL POWERS RULES, 2016 (EFFECTIVE FROM THE 1st JULY, 2016) AND RE-APPROPRIATION OF FUNDS — They shall come into force at once. An expression used in the rules but not defined shall have the same meaning as assigned to it in the Punjab Financial Rules, Volume-I. The authorities, mentioned in third column of the Second Schedule, may exercise the powers conferred in second column of the Second Schedule to the extent as mentioned in fourth column of the Second Schedule. Government may, by notification, confer any financial power of an administrative department on any officer of the Government. Government may, by notification, confer the financial power of an officer of any category as mentioned in the First Schedule on any other officer of the Government and Government may, by notification, confer the special financial power mentioned in Part-II of the Second Schedule on any officer of the Government.
